Dutch Banks Reject A Plan That Resembles the UIGEA

All avid online gamers in the Netherlands heaved a collective sigh of relief as the Netherlands Banking Association indicated to the Justice Minister that a recent proposal similar to the UIGEA in the Untied States is not feasible or legal. The regulations from the UIGEA that prevent online transactions for any dealings that concern online gambling have been shot down by Dutch financial institutions.

Dutch banks are very opposed to getting involved in the situation that the U.S. banks are currently suffering through in terms of doing business with online casinos and their patrons. An official from the group of banks and other financial institutions said that the proposal basically attempts to make the banks an extension of the justice system for the country and that is far outside the established role of banks. Ever since the UIGEA passed in 2006, banks and other financial institutions within the United States have found themselves hog-tied in this same sort of debacle. The situation looks to only get worse in the coming months as the Bush administration pushes last-minute implementation of the dreaded UIGEA regulations.

According to Eurpoean Union rules, banks can continue to do business with online gambling websites. They tried to flip it around and suggested that the Dutch government should try to prosecute an online casino operator before trying to make the banks do their murky middleman work by attempting to enforce the law. In addition to having European Union law on their side, the Dutch plan also goes against the Betting and Gaming Act.

MGM Mirage Sheds Excess Properties

With more than 865 acres along the Las Vegas Boulevard owned by the MGM mirage, the company is looking to offload a portion of their holdings in order to offset the considerable third-quarter profit loss that the company experienced. Although they have been actively amassing property along the main strip over the past recent years, they are now looking to sell some prime acreage along the strip.

Back in 2007, the MGM Mirage bought up 33.5 acres from two different owners paying $17 million per acre for a total of $576 million. That land was bought to house their Circus Circus hotel-casino. Over on the south end of the strip, the company has about 20 acres directly to the south of Mandalay Bay. They also own about 15 acres across the street from the Luxor.

Not all of the MGM Mirage’s land holdings are right along the strip. They also possess 66 acres next to Shadow Creek in North Las Vegas and 125 acres right alongside the Primm Valley Golf Club located some 35 miles south of the city. In addition they have 47 acres next to Railroad Pass in Henderson plus some 116 acres alongside Interstate 15 in Jean.

The company also has financial interest in a project going up on 79 acres at St. Rose Parkway and Las Vegas Boulevard South. The site is the future home of the $1 billion M Resort Spa and Casino. The MGM had become a project partner by putting up $160 million that translated into 50% ownership for the 11-story, 390-room project that is expected to open sometime early in 2009.

MGM Looks To Sell Prime Las Vegas Land Holdings

Look for the Las Vegas sprawl to continue expanding in the near future as the MGM Mirage contemplates selling some undeveloped land located on the strip. With the economy continuing to sink to epic new lows, the company is exploring any and all ways that they can improve their liquidity. The sale of this land would be in addition to the offloading of other assorted non-core assets such as three company airplanes. If the land is sold, that could bring the company some $300 million.

As the third-quarter profit for MGM Mirage took a major hit and fell by 67%, investors are watching closely as the company scrambles to come up with enough funds to cover loans and to complete its $9.1 billion CityCenter project on the strip. Just recently, the shares for MGM Mirage were priced at about $10.65 a piece. That is 88.5% lower than they were in December of 2007 when they were worth approximately $92.69 each.

Company officials are hoping that this move will help out their floundering balance sheet. One section of land that may be up for grabs is a spot at the southwest corner of Las Vegas Boulevard and Sahara Avenue on the south end. The MGM Mirage has made a considerable effort in recent years to acquire a huge amount of land along the strip. The company now has land holding that consist of about 865 acres along the main boulevard including three miles of land that runs along the front edge of the strip. Although land prices are bad, they are still much higher than what the company has down on their books.

UIGEA Regulations Do Not Address Problem Gambling

While the regulations of the Unlawful Gambling Enforcement Act (UIGEA) have been published and are set to be implemented on January 19th of the coming year, they have missed addressing one major issue. The UIGEA regulations are set up with the aim of cutting off funds to gamblers by hitting banks and other financial institutions and having them shoulder the responsibilities in regard to blocking online transactions that are associated with internet gambling. The regulations, however, missed a huge issue because they do nothing in terms of addressing problem gambling. Nor does it provide any money for making progress in that area of concern.

While people may talk a good game about putting an end to problem gambling, few progressive and pragmatic notions ever really take hold in any meaningful way to actually address the problem. The help provided in this regard is usually very indirect – it usually amounts to nothing more than the equivalent of cutting off money for people who have a drinking problem. None of the proposals ever address the root cause of the issue. The only thing that the UIGEA regulations will accomplish is to make it a bit more challenging to get their gambling needs met by one single venue.

None of the money that has been allocated to help enforce the regulations from the UIGEA are set up to address the issue of problem gambling. Problem gambling involves a preoccupation with gambling, a desire to bet more money more and more often, restlessness and irritability when an attempt is made to stop, a loss of control and ‘chasing’ losses. The online gambling industry itself has not made much progress in terms of addressing the issue of problem gambling, choosing instead to wait for solid and lasting regulations to be put in place before making any sort of move in that direction on their own.
